An arrest is made in accordance with the provisions of the Criminal Code. Regardless of whether or not a criminal charge is laid, the offender's identity information and details of the offence are passed to ACLAiM where it is examined and processed and a demand letter is issued. The case continues until restitution is made, the matter is settled or proceedings in civil court are concluded.
The amount of the claim is decided in consultation with ACLAiM using a prescribed formula that considers investigators' time, costs of re-stocking, report making, loss of sales opportunities and other factors.
The civil recovery process is unique. Even though all offenders are entitled to their day in civil court, they also have the option to settle the matter beforehand. This fact often reduces the number of court appearances that are necessary. For cases that do go to court, evidence may be presented by way of Affidavit. This enables your investigators to remain on the floor instead of spending time awaiting trials in court buildings.
If you utilize professional investigators and their reports are properly prepared and submitted in accordance with ACLAiM standard policy, there is no charge. If you do not have trained investigators, for a reasonable fee, ACLAiM's staff is available to lead you step-by-step through the arrest process. ACLAiM recovers its costs from the accused.
